18 U.S.C. 2257 Record-Keeping Requirements Compliance Statement

1. All content is user-generated

All photos, videos, text and other material on SwingPlace are uploaded by our members. The operator of SwingPlace does not create, film, commission or edit member content.

With respect to all member-uploaded content, the operator of this website is not a “producer” (primary or secondary) of any visual content as that term is defined in 18 U.S.C. § 2257 and 28 C.F.R. § 75.1. The operator’s activities with respect to such content are limited to the transmission, storage, retrieval, hosting and/or formatting of material posted by third parties, which are excluded from the definition of “produces” under 18 U.S.C. § 2257(h)(2)(B)(v) and 28 C.F.R. § 75.1(c)(4)(ii).

2. Members’ obligations

• Every member must be at least 18 years old (or the age of majority where they live, if higher).
• By uploading content, a member represents and warrants that every person depicted was at least 18 years old when the content was created, consented to being recorded and to the content being published on SwingPlace, and that the member has the right to share it.
• Members who upload sexually explicit content represent that they (as the producer of that content) hold, and will keep, the age-verification and consent records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for every person depicted, and will provide them on request.

3. Age verification

Whenever there is any doubt about a member’s age or the age or consent of anyone shown in their content, we require age and identity verification (KYC), such as a selfie with the username and date and, where needed, a government-issued ID. Content stays hidden and the account may be restricted until verification is completed. Members can verify at any time on the verification page.

4. Zero tolerance for minors

SwingPlace has zero tolerance for any content depicting, involving or sexualizing minors, including role-play or wording that suggests a participant is under 18. Such content is removed immediately, the account is permanently banned, and the matter is reported to the National Center for Missing & Exploited Children (NCMEC) and law enforcement where required by law.

5. AI-generated characters

Characters shown on our promotional landing pages are fictional and entirely AI-generated; no real people or performers were used to create them. All such characters are depicted and described as adults, and every image is checked by an automated review that rejects anything that could look underage.

6. Reporting

If you believe any content on SwingPlace shows a minor, was posted without consent, or otherwise violates this statement, use the Report link next to the profile, photo, video or post, or follow the steps on our DMCA & Content Removal page, or email legal@swingplace.net. Reports involving minors are handled with top priority.
